Terms of Service

The agreement governing use of the hosted Reqcore applicant tracking system: accounts, subscriptions, acceptable use, data ownership, warranties, liability, and termination.

Terms of Service

Version: 1.0 Effective date: August 30, 2026

Draft pending legal review. This document has not yet been reviewed by Norwegian counsel. Do not present it to a customer as executed terms until that review is complete — see LEGAL-REVIEW.md in this repository for the open items, including the liability cap, the consumer-law carve-out, and the company's registered details.

These Terms of Service (the "Terms") govern your use of the hosted Reqcore applicant tracking system at reqcore.com and app.reqcore.com (the "Service"), operated by Reqcore, Inc. ("Reqcore", "we", "us").

By creating an account, or by using the Service, you accept these Terms. If you accept on behalf of an organization, you confirm you have authority to bind it, and "you" means that organization.

The self-hosted, open-source distribution of Reqcore is licensed separately and is not covered by these Terms.

1. The Service

Reqcore is a multi-tenant applicant tracking system. We provide it on a subscription basis, in the state described in our documentation and on our pricing page.

We may change, add or remove features. Where a change materially reduces the functionality of a paid plan, we will give you at least 30 days' notice by email and you may terminate for that reason without penalty, with a pro-rata refund of prepaid fees for the unused remainder of your term.

2. Accounts

You must provide accurate registration information and keep it current. You are responsible for activity under your account and for the security of your credentials, and you must notify us promptly at security@reqcore.com if you believe an account has been compromised.

You must be at least 18 years old and have the legal capacity to enter into these Terms.

Each user of the Service must have their own account. Do not share credentials.

3. Plans, fees and payment

Plans, prices and included limits are as published on our pricing page at the time you subscribe. Fees are stated exclusive of VAT and other applicable taxes, which are added where required.

Billing. Subscriptions are billed in advance, monthly or annually according to the plan you select, through our payment processor. Payment is due on invoice.

Renewal. Subscriptions renew automatically for successive terms of the same length unless cancelled before the end of the current term. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current paid term.

Refunds. Fees already paid are non-refundable except where these Terms say otherwise or where a mandatory rule of law requires a refund.

Price changes. We may change prices with at least 30 days' notice by email. A change takes effect at your next renewal, not mid-term. If you do not accept it, cancel before the renewal date.

Non-payment. If an invoice remains unpaid 14 days after it falls due, we may suspend the Service after giving you notice and a reasonable chance to pay.

Free plan. The free plan is provided as-is and may be changed or withdrawn with 30 days' notice.

4. Your data

You own your data. You retain all rights in the content you and your users submit to the Service, including candidate records, documents, job descriptions and configuration ("Customer Data"). We claim no ownership of it.

We process it on your instructions. For personal data within Customer Data, you are the controller and we are the processor. The Data Processing Agreement forms part of these Terms and governs that processing. It is incorporated by reference and applies automatically — you do not need to request or sign anything separately, though we will provide a signed counterpart on request.

Licence to operate the Service. You grant us a non-exclusive, worldwide licence to host, copy, transmit, display and process Customer Data solely to provide, secure and support the Service, and as otherwise instructed by you. The licence ends when the data is deleted under §11.

We do not train models on your data, and we do not use Customer Data for our own purposes.

Aggregated statistics. We may compile aggregated, anonymised statistics about use of the Service — for example, how many organizations use a given feature. Such statistics never identify you, your users or any candidate, and we may use them freely.

Your responsibilities. You are responsible for the lawfulness of the Customer Data, for having a valid basis to collect and process it, for information you must give candidates, and for any AI feature you choose to enable. See §4 of the DPA.

5. Acceptable use

You must not:

  • use the Service in breach of applicable law, including employment, anti-discrimination and data protection law;
  • use it to process personal data you have no lawful basis to process;
  • upload malware, or attempt to gain unauthorised access to the Service, other tenants' data, or the underlying infrastructure;
  • probe, scan or load-test the Service without our prior written consent — for authorised security research, contact security@reqcore.com first;
  • resell or provide the Service to a third party as a service bureau, except under an agency plan agreed with us;
  • scrape or bulk-extract data other than through the export features provided;
  • circumvent plan limits, or use automation to inflate usage.

We may suspend access without prior notice where necessary to protect the Service, other customers, or a third party from imminent harm. We will tell you why as soon as we reasonably can and restore access once the cause is resolved.

6. AI features

Some features send Customer Data to third-party AI providers. They are disabled by default and only operate if you enable them.

AI output is advisory. Scores, summaries and assistant answers can be wrong, incomplete or biased, and may be presented confidently while being incorrect. Do not use them as the sole basis for a decision about a person.

You are responsible for human oversight of your recruitment decisions, for telling candidates that automated analysis is used, for handling objections and requests for human review, and for your obligations as a deployer under Regulation (EU) 2024/1689 (the EU AI Act), under which recruitment is a high-risk use case.

Usage of platform-funded AI is metered per plan. When your allowance is used up, AI features stop until the next period or until you supply your own provider key.

7. Availability and support

We aim to keep the Service available and will use commercially reasonable efforts to do so, but the Service is provided without an availability commitment unless you have a written service level agreement with us.

Planned maintenance will be announced in advance where practicable.

Support is provided by email at support@reqcore.com, during Norwegian business days, on the terms of your plan.

8. Confidentiality

Each party may receive information from the other that is confidential. Each party will protect the other's confidential information with at least reasonable care, use it only to perform under these Terms, and not disclose it except to personnel and advisers who need it and are bound by equivalent obligations.

This does not apply to information that is public through no fault of the receiving party, was already lawfully known to it, is independently developed, or must be disclosed by law — in which case the receiving party will, where lawful, give notice first.

9. Warranties and disclaimers

We warrant that we will provide the Service with reasonable skill and care, and that we have the right to enter into these Terms.

Otherwise, and to the extent permitted by law, the Service is provided "as is". We do not warrant that it will be uninterrupted or error-free, that it will meet your requirements, or that AI output will be accurate.

Reqcore does not provide legal advice. Nothing in the Service, its documentation, or these Terms is legal advice. Compliance with employment, anti-discrimination and data protection law in your jurisdiction is your responsibility.

Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, for fraud, or — where you are a consumer — under mandatory consumer protection law.

10. Limitation of liability

Subject to §9:

  • Neither party is liable for indirect or consequential loss, loss of profit, loss of revenue, loss of goodwill, or loss of anticipated savings.
  • Each party's total aggregate liability arising out of or in connection with these Terms in any twelve-month period is limited to the fees you paid or owed for the Service in the twelve months before the event giving rise to the claim.

These limits do not apply to your obligation to pay fees, to either party's breach of §8 (confidentiality), or to liability that cannot be limited under applicable data protection law.

11. Term, termination and data return

These Terms apply from when you create an account until terminated.

You may terminate at any time by cancelling your subscription and closing your account.

We may terminate for material breach that you do not cure within 30 days of written notice, or immediately where the breach is incapable of cure or where required by law.

On termination, your access ends at the end of your paid term. You have 30 days from termination to export your Customer Data through the Service or to request it from us in a structured, machine-readable format. After that period we delete it in accordance with §11 of the DPA.

Sections 4 (your data ownership), 8, 9, 10, 12 and 13 survive termination.

12. Changes to these Terms

We may update these Terms. For material changes we will give at least 30 days' notice by email to your account contact and update the version and date at the top of this page.

If you do not accept a material change, you may terminate before it takes effect and receive a pro-rata refund of prepaid fees for the unused remainder of your term. Continuing to use the Service after a change takes effect means you accept it.

We keep a record of which version of these Terms each account accepted, and when.

13. General

Governing law. These Terms are governed by the law of Norway, excluding its conflict of law rules and the UN Convention on Contracts for the International Sale of Goods.

Jurisdiction. The Norwegian courts have exclusive jurisdiction, with Oslo tingrett as the agreed venue at first instance. If you are a consumer, this does not deprive you of the protection of mandatory rules of the country where you live.

Assignment. You may not assign these Terms without our written consent. We may assign them to a successor in connection with a merger, acquisition or sale of substantially all our assets, on notice to you.

Entire agreement. These Terms, the DPA, the Privacy Policy and any written order form or SLA you have signed with us are the entire agreement between us on this subject, and replace any prior understanding.

Severability. If a provision is held unenforceable, it is modified to the minimum extent necessary to make it enforceable, and the rest stands.

No waiver. A failure to enforce a provision is not a waiver of it.

Force majeure. Neither party is liable for a failure to perform caused by an event beyond its reasonable control, other than an obligation to pay.
